Two of our own, law professors at UMD, have written an article asserting that the fourth amendment must protect against technology as well. The paper is based on United States v. Jones, where police used a GPS on a drug dealer’s car without a warrant to convict him. Should we decide on constitutionality through a case by case basis, or should the use of technology automatically be considered an unwarranted search?
