DEA officials routinely launch criminal investigations justified by conclusions drawn from analysis of its own database containing communications metadata. The most troubling part of this new capability, however, is that officials are trained to “recreate” the data trail in a manner that conceals where the data originated. Critics have pointed out that this violates a defendant’s right to a fair trial because he or she will be unable to review potential sources of exculpatory information.
